Protective Orders and Court in VA

 

Last August, on 16th St here at the Oceanfront, there was a man who went batshit crazy and attacked a friend and I with a bokken, a giant wooden katana sword and then ran and got what looked like a rifle and pointed it at us (because we ran away as soon as he pointed it, screaming at us, I don't know what it was except a giant gun). He was definitely going to shoot.
 

After continuance after continuance the court date was supposed to be today but I got a call from the Commonwealth's Prosecutor, Charles Agerter, yesterday morning saying today's date was going to be postponed AGAIN because he had pneumonia. He told me the defendant was offered a plea but he refused it and then he asked when would be good for me in April or May. Fucking May!!!
 
Obviously, I thought I didn't need to go today, right? 
 
I was wanting to get a group together to go with me and thanks for offering !!! Thank you so much. (All the other times there's no protection for the victims in situations like this. The defendant, and his gf, follow me out to the parking lot and hang out by my car. It's fucking awful. It's why I wanted a group this time.)
 
I did go today because I wasn't sure if the protective order needed to be renewed until the next court date. The summons said 9:15am. I get there at 8:47am and they've already started!!!! They started at 8:30am and had someone sent out in the parking lot looking for me. 
 
The Judge just decided to go forward with it. And the defendant was sweating bullets because he had no lawyer, had brought no evidence, and had to represent himself. 
 
IT WAS GLORIOUS!
 
When he had attacked with the sword to start with, my friend blocked the attack by picking up a basil plant to get between us and the sword. The defendant got hit by that and that's when he ran off to get the gun. The defendant here, was pressing charges for assault and battery. Part of his plea was to NOT press those charges, but with no lawyer there, he decided to press the charges anyway.
 
And if you've never seen an idiot child be their own lawyer before, wow, it's fucking awesome. He really just kept incriminating himself over and over. And he straight lied. His story is that out of nowhere, for no reason, my friend hit him in the head with a potted plant--and he has pictures of the injury, boohoo, and in that stunned flight or fight moment--he had to go and run and get his gun. His girlfriend said the same thing--except she mentioned that she and the defendant were fighting right before that happened, he was still talking to his ex. Great time to bring that up. Super relevant. Not incriminating or showing the defendant's mind-frame at all.
 
My friend DID have a great lawyer Chad Roberts from York County (previously a Newport News Commonwealth's Attorney's Office as an Assistant Commonwealth's Attorney, ftw) as he needed one because he was being charged. When it was Chad's turn to ask questions he gave the defendant so many opportunities to amend his story and tell the truth. I kept watching what he was asking and the defendant just kept digging his hole deeper. I mean, the defendant there, had no clue it would have been so much better for him to tell the actual truth. His defense just made him look so bad and he kept mentioning extraneous details as a defense that ONLY MADE HIM LOOK WORSE AND WORSE. 
 
The defendant called his girlfriend as a witness and she kept saying things that made them look bad. Also, she wasn't dressed for court--she really looked bad. They both just looked the part of scumbag defendants. (She's been retaliatory in the mean time, calling the cops and lying to them about my friend; calling animal control to get my dog taken away saying my dog bit her----I don't have a dog) They both mentioned the defendant's temper, he mentioned going to AA and NA. 
 
So I guess he was high and drunk when this happened---HE WASN'T BREATHALYZED, that wasn't even a part of this, until he brought it in, lol!!!! No lawyer having mfer, lol.
 
That Judge was BOLD to just go ahead today. 
 
I was a witness for the Commonwealth, but without the Commonwealth's Attorney Mr. Agerter there. My friend was completely believed by the judge that hitting the defendant was in self-defense and the charges were dropped. The judge even told the defendant if he had tried that at his house it would have been worse than a getting hit with a potted plant, he would have been shot.

The judge had a clever way of getting the truth out of the defendants. He asked the defendant's girlfriend about the sword, if it fell out of the defendant's hand when he was hit with the plant. (See, he gave her an out, asking if it was out of his hand makes it easier for her to say Yes. Meaning that there WAS IN FACT a sword) And she took a long pause, head whipped to look to her boyfriend for approval, then went on to say, "Yes, it was a bokken, not a sword, there's no metal blade, it's painted black wood." She said it with this tone of like, duh, smiling, seeking approval in the worst way grinning. However, the way she described it made it seem like you really couldn't tell in the heat of the moment if it was metal or not by saying it was painted black. LOL!!!

I mean, I guess maybe the handle is painted black? But it's a giant oak wood sword. A bokken apparently. Scary. That's what was going to give him the Felony too. Because brandishing a rifle was still only a misdemeanor???

Looking back, I think this guy had run home to get the sword because he was going to break the bedroom window. The one he'd been punching while yelling that he was going to come inside and kill us.
 
Hilarious when the judge told the defendant he could ask questions, explaining that they couldn't be argumentative, etc.
All he asked Z. was, "Do you admit you hit me with the pot?"
"Yes"
Then he asked me,"Can you explain, in 5 seconds or less, how you saw me point the gun when the door was only partly opened and you weren't on the porch?"
That made everyone kind of smirk. Oh, in 5 seconds or less? Really?
The judge interrupted and said I had all the time in the world to answer, lol. Uh, yeah.
"I was on the porch. The door was open." 
 
(I'd already given my testimony to everything that had happened, what time it was, where I was, that I was already on the phone with the police since the outburst first started. What he asked had already been stated. But I bet he was so adrenaline filled he couldn't hear much but the thought train in his own head about how he was going to get out of this with no lawyer)
 
I'm unclear on what the sentence was. I was wanting this to be a felony on his record. Without Mr. Agerter, the fuck? I'll call this week to figure this out. I just don't want this guy to be able to own a weapon. Obviously. He is on good behavior for the next 360 days for me and 180 days for my friend. So, if he has a run in with the law he'll have to spend the rest of the days in jail? That's what I'm unclear on. Are they consecutive? Or what?
I do have a 2 year protective order on him though, and he can't have a gun during this time. So, that's something.
While I did wait for a while after court before going to my car (I brought a Southern Living magazine, read about flower arranging), I still ran into him and his gf in the parking lot driving out!
 
But thanks to everyone who offered to come with me, now you're all off the hook. It's done. 
 
The other things the defendant did as his own representation to incriminate himself, while he thought it was a Good defense, a Great thing to say:
-Started out by saying he was having an argument with his girlfriend. (So did she and went into what they were arguing about)
-Said he had been working on his temper. (So did she) That only makes him look more guilty.
-Said he's been going to AA and NA and did the 90 in 90. That was never an issue, the cops didn't breathalyze him.
-Part of his defense was that my friend hit him with a potted plant for no reason, and my friend has military training. (I saw the judge recognize that as, oh, so you attacked a Vet)
-My friend's lawyer gave the defendant so many chances to say the truth in questioning. He asked over and over and in different ways about the events leading up to him getting hit with a basil plant. He just wouldn't help himself and say that he charged up the porch with a weapon, the sword. Lying under oath is never a great thing for credibility.
 -The other thing that I know must be causing arguments is that when Elizabeth Schultz was asked to give testimony the very first thing she said was that they were arguing, because he's still talking to his ex, and she nodded her like you understand, right?
 
LOL!!! No, no no no no sweetie. First off they didn't need to even say they were arguing. We had no idea anyone was arguing, just someone was talking real loud for 30 minutes right outside the window. They were just asked to be quiet or move it along. But here they are just coming in and giving themselves away, while trying to look completely innocent and that they were the victims.
 
She said he was talking to his ex and they were arguing about it with a baby in her arms, to a judge, while trying to make him look like a good guy? And those 2 hate us because of all this trouble--because it's our fault right? All this trouble they're in, it's our fault. So, I know her saying that, in front of us, must just be eating him up alive. That she was making him look bad just every which away.
 
Today my friend at least got a great call from his slumlord-landlady saying she's trying to make them move out now that the verdict came down guilty. Really, this woman has been making everything so much worse than it had to be this entire time. My friend was having to move out very soon--he's wanted to be out since the start of this, but now that they could be gone very soon, he's now welcome to stay. So, that's something. It's a mess, but at least the landlady said something nice and not antagonistic here at the end of things.
 
So glad my friend's self-defense was seen for what it was and he was found Not-Guilty and today's theme on March 23rd is Gate 25, Innocence. Which both my friend and I have natally.

This Gate is part of the Channel of Initiation, A Design of Needing to be First, linking the G Center (Gate 25) to the Ego Center (Gate 51). Gate 25 is part of the Individual (Centering) Circuit with the keynote of empowerment.

The love of Gate 25 flows out of fully accepting and living surrendered to one's form. A gate of the higher self, its pivotal role is to turn people toward individuation. Our innocence is not designed to bring love into the world in any specific way, but rather to love without discrimination. Those who carry this gate hold the potential, and empower others with the potential, to love life and everything in it equally. A flower can be loved as profoundly as a human.

This quality of love is often projected as cool or cold but is neither. The mystical potential of this love is transcendent and universal, and our spirit innocence is always being tested. We have the capacity to meet these initiations from life like a spiritual warrior, fired up and ready to compete for our spirit (our individuality) no matter what the circumstance. Then, when the warrior or "fool" of Gate 51 prods us to leap into the void, or when we meet life's initiating challenges, we will be able to land on our feet and deepen our innocence into a wisdom that can empower others on their own journey. We may emerge a bit wounded from such initiations, but our ultimate triumph and survival enriches our spirit and the spirit of those around us. The result is that we are alive with the wonder, the love, of being.
